III. Position and Functions
1. Department of
Education and Training of Lam Dong province is a specialized agency of the
People's Committee of Lam Dong province which has the function to advise and
assist the provincial People's Committee in performing the function of State
management on education and training, including: objectives, curricula,
education and training content, and standards of teachers and administrators
standards of educational facilities, school equipment and toys; examination
regulations and granting diplomas, certificates; public services under the
State management on local education and training in accordance with laws.
2. Department of
Education and Training has legal status, seal and separate account and operates
under the guidance and management of the provincial People's Committee in terms
of organization, staffing and work, and subject to the MOET’s direction,
guidance in testing and inspection of the professional services.
IV. Duties And Powers
1. To submit to the
provincial People's Committee
- Decisions, directives
and other documents issued under the provincial People's Committee in the field
of education and training.
- Planning, five-year
and annual plans, programs and projects on education and training, measures to
implement administrative reform tasks in the concerned education sector under
the State jurisdiction.
- Specific tuition fees
of education and training under local management for the provincial People's
Committee to submit to the provincial Council for decision in accordance with
- The provisions on
standardized titles for heads and deputy heads of units of the Department of
Education and Training, Head and Deputy Head of Education and Training of
district people's committees.
2. to submit to Chairman
of the provincial People's Committee for issue
- The decision to
establish, merge, split, suspend and dissolve a public educational institution
directly under the Department of Education and Training; to establish, suspend
the operation of or dissolve a non-public educational institution under the
jurisdiction of the Department of Education and Training as prescribed by law;
- The prescribed
relationship between the Department of Education and Training with the relevant
departments and district people's committees;
- The decision to
recognize pre-schools and schools for national standards in accordance with the
national standards issued by the Ministry of Education and Training;
- Decisions and other
specific directives issued under the authority of the Chairman.
3. To guide the
implementation of legal documents, policies, planning, plans, projects,
programs, and other educational and training contents after they are approved;
to organize the information, propagation and dissemination of legal education
in education and training under the jurisdiction of the Department of Education
4. To provide the units
under the Department, and Division of Education and Training with the
professional guidance on implementation of goals, programs, content, plans and
activities of education and training as prescribed by law and the Ministry of
Education and Training.
5. To manage the
recruitment, examination, approval and awarding of diplomas and certificates in
accordance with the Ministry of Education and Training; to guide, control and
inspect the quality management of education and training at the local education
and training institutions.
6. To guide and organize
the implementation of compulsory education in the area under the guidance of
the Ministry of Education and Training and the provisions of law.
7. To develop plans for
training and further qualifying teachers and educational administrators of
disciplines and levels of management within the provincial guidelines; to
implement plans for training and further qualifying teachers and administrators
after being approved by competent authorities.
8. To organize the
application of experience, scientific - technological advances in education;
sum up local experiences and initiatives; manage the scientific-technological
research at educational institutions in charge of the Department of Education
and Training; build the information system and archive to serve the management
of the State and professional assignments.
9. To guide, supervise,
inspect and organize the work of emulation and commendation for the education
and training in the area; construct and advance positive models of education
and training in the province.
10. To guide and
implement the mechanisms and policies on educational socialization; mobilize,
manage and make good use of resources for education development in the area.
11. To assist the
provincial People's Committee with State management of enterprises, collective
economic organizations, and private sectors involved in education at local
levels; guide and inspect the activities of associations and NGOs working in
local education in accordance with law.
12. To lead and
coordinate with other agencies involved in the evaluation of conditions and
criteria for submission to the competent authority to grant and withdraw licenses
for the establishment and operation of the institutions involved foreign
investments; guide, control, examine and inspect the activities of the
educational institutions with foreign investments as prescribed by law.
13. To grant and revoke
the registration of service organizations which send students to study at
oversea secondary schools, vocational schools, colleges and universities under
the State jurisdiction of the Department; investigate the operation of these
organizations in accordance with the Ministry of Education and Training, and
with law; collect the statistics of oversea students under the State
jurisdiction of the Department in the province and report to competent agencies
14. To perform the tasks
of international cooperation in the field of education and training as assigned
by the provincial People's Committee, and provisions of law.
15. To guide, supervise
and inspect the implementation of autonomy, self-responsibility on the tasks,
organization, staffing, financing of units of education and training that
directly belong to the Department as assigned by the provincial People's
Committee and by law.
16. To construct and
establish the annual plan of local tenure educational and training staff;
allocate the tenure quota for the Department’s public educational units after
the competent authorities have approved of the plan; guide, examine, inspect
and implement the annual recruitment of educational staff in the province as
prescribed by law.
17. To lead and
coordinate with the Department of Finance, Department of Planning and
Investment to estimate the annual educational budget including the regular
expenditure budget and expenditures of capital construction investment, school
equipment, toys, approved national target programs; allocate and assign the
budget expenditure allocated to education; and guide and supervise the
18. To test, inspect and
handle the violations under the authority of the implementation of policies,
legislation, planning, plans, programs, schemes and regulations of the
competent authorities in the field of education and training; settle complaints
and denunciations and petitions of citizens related to education under the
management of the Department of Education and Training, practise thrift and
anti-corruption and anti-wastefulness as prescribed by provincial People's
Committee and by law.
19. Define the
functions, duties and powers of offices, inspectors, divisions and the business
units under the Department of Education and Training, manage the tenure and the
working staff of Department of Education and Training and the units under the Department;
appoint, dismiss, resign, remove from office of heads and deputy heads of
institutions under the Department ; recognize, not recognize or change the
Administrative Board members, principals of private educational institutions in
accordance with the law; and carry out the recruitment, employment contract,
transfer, rotation and other regimes and policies on preferential treatment,
commendation and disciplining of officials, public servants and employees of
the Department of Education and Training as prescribed by law.
20. Where necessary for
the development of local education and training, Director of Education and
Training Department decides on personnel, teachers of the sector after being
approved by competent authorities.
21. To be responsible
for the management of finance, property, provided facilities, organize and
implement the allocated budget assigned by the provincial People's Committee
and provisions of law.
22. To undertake
activities and report periodically on the extraordinary performance of assigned
tasks to the PPC and the Ministry of Education and Training.
23. To perform other
duties assigned by the PPC or the provisions of law.
V. Director and Vice-Directors of Department
1. Department of
Education and Training has one Director and no more than 03 Deputy directors.
2. Director of Education
and Training is the head of the Department, responsible to the provincial
People's Committee and the law for all activities of the department;
3. Deputy Director is
the assistant director of the Department, responsible to the Director and the
law for their assigned tasks; when the Director is absent, a Deputy Director is
authorized by the Director to run the Department of Education and Training.
4. The appointment of
Director and Deputy Directors is decided by the provincial People's Committee’s
Chairman based on professional standards and criteria issued by the Ministry of
Education and Training and under the provisions of law. The dismissal,
demotion, reward, discipline and other policies for the Director and Deputy
Directors of the Department shall comply with the law.
